Terms of Service

By requesting a quote, paying a deposit, confirming a booking, or using our website, you agree to these Terms of Service and to our Privacy Policy. If you are booking on behalf of a group or organization, you confirm you are authorized to accept these terms for everyone in your party, and you are responsible for making them aware of the rules that apply on board.

• “SeaSky Cruises,” “we,” “us,” “our” — SeaSky Cruises and the vessels and crew operating under it.
• “You,” “client,” “guest” — the person who makes the booking and everyone in their party.
• “Charter” — the private boat or yacht hire, scheduled cruise, or catered event you have booked.
• “Captain” — the licensed captain in command of the vessel, who has final authority over its safe operation.

Quotes are based on the details you provide — date, time, vessel, guest count, and any catering or add-ons — and are valid for the period stated on the quote. A booking is only confirmed once we have received your deposit and sent you written confirmation. Until then, your date and vessel are not held. We may decline or cancel a booking where details are inaccurate, where a vessel becomes unavailable, or where a request cannot be carried out safely or lawfully.

• Deposit — a 50% deposit is required to confirm your booking and secure your date and vessel.
• Balance — the remaining balance is due in full before boarding on the charter date.
• Taxes and fees — all prices are in Canadian dollars and subject to 5% GST. Payments made by credit card (via Stripe) include a processing fee. Interac e-Transfer payments are sent to Contact SeaSky Cruises (Luxury Sea Sky Cruises Inc.).
• Add-ons — catering, beverages, décor, extended time, and other extras are quoted and invoiced separately.

The rate covers the vessel and captain for the booked duration. Charter time runs from your scheduled boarding time; time lost because guests arrive late cannot usually be added to the end of the charter.

If you cancel or reschedule. Deposits are non-refundable, as they hold your date and vessel and turn away other bookings. If you give us at least 14 days’ notice before the charter date, we will do our best to reschedule your booking once within 12 months, subject to availability, and apply your deposit to the new date. For cancellations made within 14 days of the charter, the deposit is forfeited; if you have already paid the balance, we will refund the balance amount.

If we cancel. If we must cancel a confirmed charter for reasons within our control (for example, a mechanical issue with no replacement vessel), you may choose to reschedule or to receive a full refund of all amounts you have paid.

Weather and safety. Marine conditions can change quickly. The captain may delay, shorten, modify the route of, or cancel a charter at any time where weather or safety requires it — this decision rests solely with the captain. If a charter is cancelled before departure for weather or safety, you may reschedule or receive a refund of amounts paid. If a charter is cut short after departure, we will work with you on a fair reschedule or partial credit for the time not delivered.

Each vessel has a maximum guest capacity set by Transport Canada and our insurance, and this limit cannot be exceeded for any reason. The guest count you book must be accurate. Private charters board at Plaza of Nations or Granville Island, depending on the vessel; exact dock and arrival details are provided with the booking. Please arrive a few minutes early; for everyone’s safety, the captain may refuse boarding to anyone who is significantly impaired or unable to board safely.

The captain has full and final authority over the vessel and everyone aboard. All guests must follow the captain’s and crew’s safety instructions at all times, including the use of life jackets when directed. For everyone’s safety, the following are not permitted: interfering with the operation of the vessel; unsafe behaviour; bringing weapons, illegal drugs, or fireworks aboard; or smoking or vaping except in any area the captain designates. The captain may refuse boarding to, or end the charter early for, any guest whose behaviour is unsafe, unlawful, or abusive to crew or other guests, without refund.

On most of our vessels you are welcome to bring your own alcohol (BYOB) for your private charter, subject to British Columbia liquor laws and the rules below. Our 85ft Event Boat is the exception: because of how it operates, outside alcohol is not permitted, and any alcohol must be arranged through us in advance. Across all vessels, every guest consuming alcohol must be of legal drinking age in B.C. (19+) and may be asked for valid photo ID. The captain and crew may refuse or stop serving alcohol to, and may require the disembarkation of, any guest who is intoxicated, underage, or behaving unsafely. You are responsible for your party’s alcohol consumption and conduct, and we are not liable for the effects of alcohol consumed by guests.

Catering is prepared by our culinary partner. Please tell us about any allergies or dietary requirements when you book so we can do our best to accommodate them. While we take allergies seriously, our food is prepared in kitchens that handle common allergens, and we cannot guarantee a fully allergen-free environment. Guests with severe allergies should take their own precautions. Final menus, guest counts, and dietary details are usually required a set number of days before the charter.

You are responsible for any loss of or damage to the vessel, its equipment, or furnishings caused by you or your guests beyond ordinary wear, including damage caused by misuse or by guests who do not follow safety instructions. We may charge the reasonable cost of cleaning or repair, including for excessive mess. You are responsible for your own personal belongings; we are not responsible for items lost, damaged, or left behind on board.

Boating and on-water activities carry inherent risks. By boarding, you and your guests accept these risks and agree to follow all safety instructions. To the fullest extent permitted by law, SeaSky Cruises is not liable for indirect, incidental, or consequential losses, and our total liability arising from a booking is limited to the amount you paid for that booking. Nothing in these terms limits any liability that cannot be excluded under applicable law. Guests may be asked to sign a separate safety and liability waiver before boarding.

You agree to indemnify SeaSky Cruises against claims, losses, and costs arising from your or your guests’ breach of these terms, unsafe or unlawful conduct, or damage caused on board.

We may take photos and video during charters and use them to promote our services on our website and social media. If you or a guest would prefer not to appear, let your captain know during the charter or contact us, and we will accommodate the request. See our Privacy Policy for more.

The content on our website — including text, images, branding, and the SeaSky Cruises name and logo — belongs to us or our licensors and may not be copied or used without permission. Please use our website lawfully and do not attempt to disrupt it or misuse its forms. Our website may link to third-party platforms (such as booking marketplaces and our payment processor); we are not responsible for the content or practices of those third parties, which have their own terms and policies.

How we handle your personal information is described in our Privacy Policy, which forms part of these terms.

We are not responsible for failure or delay in providing a charter caused by events beyond our reasonable control — including severe weather, marine hazards, mechanical failure, emergencies, port or dock closures, or government restrictions. Where such an event prevents a charter, we will offer a reschedule or a fair refund for the part not delivered.

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. Any dispute relating to these terms or a booking will be dealt with in the courts of British Columbia.

We may update these terms from time to time. The current version is always posted on this page with its effective date, and the terms in effect at the time of your booking apply to that booking.
